By accessing or browsing the Website, or purchasing any service offered by UCADEMY, you become a User and expressly accept these Terms without reservation, along with the Legal Notice, Privacy Policy, and Cookie Policy. If you do not accept these Terms, you must not use the Website or purchase UCADEMY's services.
2. Purpose and description of the services
UCADEMY provides online and blended learning services to prepare students for:
- University entrance (Selectividad/EBAU/EVAU, university entrance for people over 25, PCE for international students, and Exames Nacionais) through the Atlas brand.
- Civil service exams for different public bodies and administrations through the Polaris brand.
- Official vocational education (intermediate and advanced programmes) through the Explora brand.
Users receive the details of each service, including its content, duration, format, teaching staff, materials, tutoring, mock tests, certificates or qualifications, and entry requirements, before purchase. These details appear on the relevant product page and/or in a personalised proposal sent by the sales team.
Content and services are accessed through the virtual campus at https://app.ucademy.com/ using a personal username and password that cannot be transferred to anyone else.
3. Eligibility to enter into a contract
To purchase UCADEMY's services, Users must be of legal age and have full legal capacity. Minors may purchase services only through their parents or legal guardians, who will be the parties to the contract and responsible for the obligations arising from it.
4. Purchasing process
Users can purchase services through the channels UCADEMY makes available, such as a web form, a phone call with an advisor, email, or another channel. The process will include at least:
- A request for information and, where applicable, personalised advice from the sales team.
- Presentation of the specific terms of the service to the User (price, duration, content, and payment method).
- The User's express acceptance of these Terms, the applicable specific terms, and the privacy and cookie policies.
- Confirmation of the purchase by email and issuance of the corresponding invoice.
5. Price and payment
Users will be informed of the price of each service before entering into the contract. Prices will include any legally applicable taxes where appropriate.
UCADEMY accepts various payment methods, including payment card, direct debit, bank transfer, and financing through an authorised provider. Card payments are processed through secure payment gateways, particularly Stripe. UCADEMY does not access or store full card details.
For payments made in instalments, failure to pay an instalment may result in temporary suspension of access to the service after the User has been notified. It may ultimately result in termination of the contract, without affecting UCADEMY's right to claim outstanding amounts.
6. Contract duration
The contract will last for the period stated in the specific terms of each service. Unless expressly agreed otherwise, UCADEMY's services do not renew automatically.
7. Right of withdrawal
Users who qualify as consumers under Article 3 of Royal Legislative Decree 1/2007 of 16 November, approving the consolidated text of the General Consumer and User Protection Act (TRLGDCU), have fourteen (14) calendar days from the date the contract is entered into to withdraw from it without giving a reason.
To exercise the right of withdrawal, Users must notify UCADEMY through an unequivocal statement, such as a letter sent by post or an email, using the postal or email address given in Section 1. The notice must be sent before the withdrawal period expires.
If a User withdraws from the contract, UCADEMY will refund all payments received from them without undue delay and, in any event, no later than 14 calendar days after being informed of the decision to withdraw. The refund will be made using the same payment method used for the original transaction, unless the User has expressly agreed otherwise, and at no cost to the User.
Loss of the right of withdrawal for digital content and services. Under Article 103(m) of the TRLGDCU, the right of withdrawal does not apply once provision of the service or access to the digital content has begun with the User's prior express consent and acknowledgement that they will consequently lose their right of withdrawal. If a User expressly asks for the service to begin during the withdrawal period and subsequently decides to withdraw, they must pay UCADEMY a proportionate amount for the services actually provided.
8. Returns and refunds policy
In addition to the statutory right of withdrawal described above, the specific terms of each service may provide for additional refunds, changes to the learning format, deferrals, or specific commercial guarantees. Users will receive these terms when purchasing the service. Where they are more favourable to the User, they will take precedence over this section.
9. Users' obligations
Users agree to:
- Provide truthful, accurate, and up-to-date information during the purchasing process and keep it updated throughout the contract.
- Use the Website, virtual campus, and services responsibly, lawfully, and in accordance with these Terms.
- Keep their virtual campus login details secure, refrain from sharing them with third parties, and inform UCADEMY immediately if they are lost or used without authorisation.
- Refrain from reproducing, copying, distributing, modifying, selling, or making available to third parties any content, materials, or courses accessed through UCADEMY without UCADEMY's prior written authorisation.
- Follow the rules for using the virtual campus and the instructions of teaching and support staff.
10. Intellectual and industrial property
All content, teaching materials, videos, audio recordings, exercises, mock tests, tools, software, trademarks, logos, trade names, designs, and other materials made available to Users through the Website, virtual campus, or any other UCADEMY channel belong exclusively to UCADEMY or to third parties who have authorised their use. They are protected by Spanish and international intellectual and industrial property law, particularly Royal Legislative Decree 1/1996 of 12 April, approving the consolidated text of the Intellectual Property Act, and Law 17/2001 of 7 December on Trademarks.
Purchasing UCADEMY's services gives the User a personal, non-transferable, limited, and revocable licence to access the content for the duration of the contract, solely for personal study. Reproducing, distributing, publicly communicating, modifying, or commercially exploiting the content in any other way without UCADEMY's prior written authorisation is expressly prohibited.
11. Data protection
Users' personal data is processed in accordance with UCADEMY's Privacy Policy and applicable data protection law (GDPR and LOPDGDD).
12. Liability
UCADEMY is responsible for providing the purchased services in accordance with their applicable specific terms and as provided by civil and consumer law. UCADEMY is not responsible for:
- Interruptions or failures of the Website or virtual campus caused by force majeure or circumstances beyond UCADEMY's control.
- Viruses or other harmful elements introduced by third parties.
- The User's misuse of the Website, virtual campus, or services.
- Third-party content linked from the Website or virtual campus.
The above does not exclude or limit any liability to consumer Users that UCADEMY cannot legally exclude.
13. Changes to the Terms
UCADEMY reserves the right to change these Terms at any time, particularly for legal or regulatory reasons or as its services develop. Changes take effect when published on the Website and apply only to subsequent purchases. Existing contracts remain subject to the version the User accepted when purchasing the service, unless a change is required by mandatory law.
14. Notices
UCADEMY may send communications relating to the contract to the email address provided by the User or through the virtual campus.
15. Dispute resolution
These Terms are governed by Spanish law.
Consumer Users may use the European Commission's Online Dispute Resolution platform, available at https://ec.europa.eu/consumers/odr/, to resolve disputes arising from online purchases.
Without prejudice to the above, UCADEMY and the User expressly waive any other jurisdiction that may apply and submit disputes arising from access to or use of the Website or the purchase of services to the courts of the consumer User's place of residence or, for Users who are not consumers, the courts of Madrid, Spain.
